1. Acceptance of Terms

By accessing or using the Actyra Open platform (“Service”), operated by Actyra (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

2. Description of Service

Actyra Open is a research and educational platform that provides binary analysis reports, security findings, and privacy assessments of publicly available software. The Service includes:

  • Software analysis reports accessible via web interface
  • A REST API for programmatic access to findings data
  • Search and comparison tools for analyzed software
  • Account management and API key generation

3. Accounts

Some features require a registered account. When creating an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access
  • You may not share your account or API keys with third parties
  • We reserve the right to suspend or terminate accounts that violate these Terms

5. API Usage

Access to the Actyra Open API is subject to the following terms:

  • Rate limits — API requests are subject to rate limiting. Current limits are enforced per IP address and per API key.
  • Authentication — API access beyond public endpoints requires a valid API key or JWT.
  • Acceptable use — API access must not be used for automated scraping at excessive rates, denial-of-service attacks, or any unlawful purpose.
  • Attribution — If you republish data obtained from the API, you must attribute Actyra Open as the source.
  • No resale — You may not resell API access or bulk data without written permission.

6. Acceptable Use

You agree not to use the Service to:

  • Exploit discovered vulnerabilities documented in our reports against affected vendors or their users
  • Develop malware, exploits, or attack tools based on our findings
  • Harass, threaten, or defame software vendors or their employees
  • Misrepresent our findings or take them out of context
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Circumvent rate limits or access controls
  • Use the Service for any purpose that violates applicable law

7. Intellectual Property

Our content: Analysis reports, findings, grades, and commentary published on Actyra Open are the intellectual property of Actyra. You may reference and link to our reports for educational, journalistic, or research purposes with attribution.

Analyzed software: All software analyzed on this platform is the intellectual property of its respective vendors. Trademarks, product names, and company names are used solely for identification purposes and belong to their respective owners.

Evidence excerpts: Code excerpts published in our reports are limited to the minimum necessary to substantiate specific findings, consistent with fair use principles under 17 U.S.C. § 107.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make reasonable efforts to ensure accuracy of our analysis but do not guarantee that findings are complete, current, or free from error. Software vendors may update their products at any time, and current versions may differ from analyzed versions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACTYRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless Actyra, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Paid Subscriptions

Paid subscriptions are billed through Stripe. By subscribing:

  • You authorize recurring charges at the current subscription rate
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Cancellations take effect at the end of the current billing period
  • Refunds are available within 14 days of initial subscription if you are unsatisfied
  • We reserve the right to change pricing with 30 days' notice

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us at hello@actyra.com. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability and indemnification) shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Pinellas County, Florida.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
